Under the provisions of the Personal Data Federal Law held by private parties (LFPD)
and other applicable provisions, Administración Riviera Resorts, S.A. de C.V.
(hereinafter and indistinctly, “One on One Trade”), which is settled to hear and
receive notifications at Km 21 of the Highway Cancun-Puerto Morelos, Z.P. 77500,
in the city of Cancun, Municipality of Benito Juarez, State of Quintana Roo, expressly
informs:

provided by One on One Trade ®. You may revoke your consent to process your personal
data as regards the mentioned additional purposes, at any time, through the mechanisms
provided in this Privacy Notice in accordance with the current legislation.

Controlling, subsidiary or affiliated partnerships with One on One Trade.
Your personal data may be transferred and processed by persons other than the liable.
The addressees of such transfers (domestic or international) belong to the following
categories:

Controlling, subsidiary or affiliated partnerships with One on One Trade;
for purposes of centralized backup of information, control of registration and deregistration,
change in the reservation services; as well as the development of statistics of
the liable person users in order to asses, improve and design new services for those
users.

Non-affiliated third parties (service providers), with the sole and only
purpose to assist One on One Trade to market the transferred membership.

Business Partners, to promote and/or sponsor the membership.
- Consent to transfer data.
The transfer of personal data referred in the numbers 1 and 2 of the former item,
does not require your consent in order to be executed, according to what is provided
in the article 37 of the Personal Data Federal Law. In order to transfer personal
data as it is referred in the number 3 of the immediate former item, we require
your consent. I consent to transfer my personal data to third parties which are
identified as “Business Partners”, for the expressed purposes. The knowledge and
acceptance of the present Privacy Notice through the present, entails the consent
to carry out the transfer of the personal data to the “Business Partners”. You may
communicate at any time, to One on One Trade, your desire to withdraw your consent
for future transfers of your personal data. Your personal data won’t be transferred
to third parties without your consent, except in case of the provisions stated in
the article 37 of the Personal Data Federal Law and always complying with the conditions
stated in the article 17 of the Personal Data Federal Law regulations.
Exercise of ARCO rights.
In all those legally originated cases, you may exert your rights of access, rectification,
cancelation and opposition at all times (ARCO rights) through the implemented procedures.
The corresponding request must comply with the requirements stated in the legislation
in force, through a letter addressed to our person in charge of the Personal Data,
located at Km 21 of Cancun Puerto -Morelos Highway, Z.P. 77500, in the City of Cancun,
Municipality of Benito Juarez, State of Quintana Roo.
The request must contain and be accompanied by the following:
- Name and address or any other mean to receive replies to your request.
- Documents that accredit your identity or legal representation, if applies.
- Clear and accurate description of the personal data with reference ARCO rights
that are wanted to be executed;
and Any other element or document that makes finding the personal data easier.
The liable person will communicate, within a term of twenty working days maximum,
starting on the date that such request is received, the determination taken. If
the request proceeds, this will take effect within the following fifteen days after
the liable person responds. In case that the information provided in your request
is wrong or incomplete, or if it does not have attached the corresponding necessary
documents to accredit the identity or legal representation, the liable person, within
the following five working days after the reception of the requests, will require
an amendment of the deficiencies in order to pursue. In these cases, you will count
on ten working days to attend the amendment requirement, starting from the day after
having received the response. The corresponding requests will be deemed as not submitted
if you do not reply within the mentioned term.
You may be able to obtain personal
data or information requested through simple copies, electronic documents (Word,
PDF, etc.), with restricted and authorized access to the system that will process
your personal data (access) or through any other legitimate mean which guarantees
and accredits the effective exercise of the requested right.
Alternatively, the
entitled person will be able to make his request through derechosARCO@oneonone.mx
as long as he complies with all the requests mentioned above, setting as the communication
subject “ARCO rights and/or consent revocation”. The terms for the procedure will
be the same referred in the immediate former paragraph. The use of electronic media
for the exercise of ARCO rights authorizes the liable person to respond the corresponding
request by the same mean, unless the entitled person demands clearly and expressly
another communication mean. You will be responsible to keep updated your personal
data in the possession of the liable person. Therefore, you stand for and ensure,
at any case, the veracity, accuracy, validity and authenticity of the personal data
that you have provided, owing to communicate any further change to the liable person.
Revocation of consent.
You will be able to revoke your consent to process your personal data, with no retroactive effects, in every case, where such revocation does not suppose the impossibility to comply with the obligations derived from a juridical relationship between you and the liable person.
The procedure for the revocation of the consent, where appropriate, will be the same as the one established in the immediate former item for the exercise of ARCO rights
Limitations for personal data disclosure.
You may limit the use or disclosure of your personal data by issuing the corresponding request to our Personal Data Department. The requisites to accredit your identity, as well as the procedure to attend your request will be the same as the ones indicated in the item H) of the present Privacy Notice (Exercise of ARCO rights).
Automatic means to collect your personal data.
One on One Trade does not authorize any electronic means to collect personal data.
Modifications or updates of the present Comprehensive Privacy Notice.
The liable person will be able to modify, update, extend or change any other how the content and scope of the present Privacy Notice, at any time, and under its full discretion. In such case, One on One Trade will notify the changes to the present Privacy Notice by email, if this mean has been set as the communication channel between you and the liable person for receiving the services provided by One on One Trade.
